TERMS OF LEASE
In addition to the terms below, and the operation guidelines on each rented item, the Lessee (customer) agrees to supervise the operation of any rented item and further agrees that if the item is damaged that he/she will reimburse JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC for the full price to fix the damage and/or the full replacement value of the rented item. Before signing this contract, Lessee agrees that he/she has read the entire contract, has agreed to all terms and conditions herein, and has had all questions he/she may have answered to the Lessee’s full satisfaction and understanding.
Delivery/Operation/Payments: To address specified by Lessee. Lessee grants JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC and its employees/contractors, the right to enter said property for the delivery and return of the rented equipment at approximate times. All payments must be made at the time of delivery. No refunds will be made after the equipment has been delivered. For jumpers, the lessee agrees to provide one electrical outlet rated at 115 volts with 20 amperes capacity per motor unit within 50 feet of each unit. No electrical cords are to be used. If the blower stops or the air pressure is low, remove all users immediately, and then check on the problem. Air tubes in the rear of the unit should be tied securely to the blower or tied off to prevent air from escaping. The electrical cord should be plugged into an outlet and be the only thing operating on that electrical circuit. Circuit breakers should also be checked. The customer is subject to an additional charge of $35.00 for all service calls due to electricity. Sometimes we have pickups at the same time as more than one party so therefore pickups are determined by the pickup crew. It maybe is after your party or cutoff time.
General Rules for Safe Operation: Units must be operated over a smooth, compatible surface such as grass or hard top surface. The unit may NOT be operated on rough surfaces such as rocks, brick, glass, or any jagged objects. The unit cannot be moved by the lessee after being placed by JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC employees/contractors. Unit MUST BE properly anchored prior to use. The unit will be anchored initially by JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC employees/contractors and the anchors MUST NOT be removed during the period of use. Never attempt to relocate, adjust or service a blower. Never use during high winds, gusty winds, thunderstorms, or lightning. The unit can turn over in high winds, even if anchored, and this could result in severe injuries to the users. Do not resume use until adverse weather conditions have ceased. Always follow the manufacturer's guidelines located on the unit itself.
Additional Safety Rules: Before entering the unit, have the users remove their shoes, eyeglasses, belt buckles, and any sharp objects. Never play, jump or enter a partially inflated/deflated unit. Never allow the users to climb or play on the outside or inside walls of the unit, columns, netting, or roof of the unit. Always follow the number of riders and rules posted on the unit itself. Do not plug or unplug the motor repeatedly as this will cause the unit to burn up and you will be responsible for any resulting damage. Always have an adult present, who has reviewed and understands both this contract and the rules posted on the unit itself, and who can supervise the riders. Never allow the users to be unsupervised in or around the unit. Never allow more users than the maximum number of users per age group as described within this lease and on the unit itself. Never place a hose or water on or into the unit unless authorized by JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC. Do not allow horseplay on, in, or around the unit. Always follow the directions for use on the unit itself.
Only children of the same age group are to play in the unit at the same time.

Additional Terms of Lease: JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC is not responsible for bad weather, disruption of electrical service, and/or unfavorable conditions that may arise, and no charges or fees will be reimbursed. NO silly string or similar items, such as but not limited to food, drinks, confetti, foam, or trash, in or around the unit at any time !!! Silly string and like objects will cause permanent damage to the unit, and the lessee will be responsible for the full replacement value of the rented unit and/or assessed a $75.00 cleaning fee if the unit is determined not to be permanently damaged. Lessee agrees not to operate the unit(s) contrary to this contract and the use rules on each unit. If the lessee operates the unit (s) contrary to the contract and rules of use on each unit, and the unit is damaged, Lessee agrees to pay the cost or repair or full replacement value of any damaged equipment or unit. Lessee agrees that the equipment leased is for Lessee’s use, and said equipment is not to be loaned, sub-let, mortgaged, or in any other manner disposed of by Lessee. Lessee further agrees to be liable for any equipment loss by fire, theft, or other cause. If a unit is rented to be dry and you use water or take it upon yourself, you will pay a $75.00 drying fee. We have a water unit, so please rent the water unit if you want to have water.
SET UP TERMS: We are not responsible for any yard or yard decor or fixture damage that may occur from my truck or set crew may cause.
Hold Harmless Provisions: Lessee agrees to indemnify and hold JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC harmless from any claims, actions, suits, proceedings, costs, expenses, fees, damages, and liabilities, including, but not limited to, reasonable attorney’s fees and costs, arising because of injury, damage, or death to persons or property, in connection with or resulting from the use of the leased equipment. This includes, but is not limited to, the manufacture, selection, delivery, possession, use, operation, or return of the equipment. Lessee hereby releases and holds harmless JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC from injuries or damages incurred due to the use of the leased equipment. JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC cannot, under any circumstances, be held liable for injuries due to inappropriate use, God, nature, or other conditions beyond its control or knowledge. Lessee also agrees to indemnify and hold harmless JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC from any equipment loss, damage, theft, or destruction during the lease term and any extensions thereof.
Disclaimer of Warranties: JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC makes no warranty of any kind, either express or implied, as to the condition of or performance of any leased equipment, and the Lessee agrees to immediately cease use of the equipment and contact JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC if any of the leased equipment develops any indication defect or improper working conditions. Lessee agrees to use the equipment at Lessees' own risk.
Breach/Indemnity/Arbitration: If Lessee breaches any of the terms of this lease, that Lessee will pay for all consequential damages and further indemnify JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC for all costs incurred by JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC incurred in enforcing the terms of the lease or in defending any claim or lawsuit arising out of the operation of said equipment, including the amount of any judgment, attorney’s fees, and costs. If JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC determines, within its discretion, that Lessee has failed, in any way, to observe or comply with the conditions of this lease, JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC may exercise any of the following remedies: termination of this agreement; reenter property and retake the equipment; declare any outstanding rent and charges immediately due and payable and initiate whatever legal proceedings necessary to recover said equipment or monies; and/or pursue any additional remedies available it by law. If a conflict arises, JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC and Lessee will abide by the Georgiastate laws and forgo filing a lawsuit to solve the dispute.
Inclement weather: Once we deliver the equipment, you are responsible for the entire rental fee even if the weather becomes inclement. If inclement weather is not expected to pass during your event, we may begin to pick up the units early for the safety of our equipment and our staff.
Trackless Train Rental Agreement
1. The train cannot be taken down or up steep hills when loaded with children. Never drive sideways up or down a slope
2. You agree to seat belt all children before giving train rides.
3. You agree to use the train with the utmost safety.
4. Do not take the train into any heavy traffic areas. (Roads, highways, etc.)
5. We will always blow a horn before pulling out and entering the pick-up area.
6. No more than 18 kids at one time on the train.
7. No more than 12 on the train when mixing adults plus kids.
8. No standing up on the train allowed.
9. Always shut the doors before pulling out.
10. Always check tires for low air before and after use.
11. You agree to pay fixing costs for any careless use of the train that may cause damage to the train. (example: taking over steep hill and wreck, flip, graffiti, letting your children or kids under your care act carelessly)
12. If used for a charity or fundraiser attraction, we get 50% of the draw.
13. You agree that accidents can occur and you (renter) take all responsibility if any lawsuit or accident arises from using the train.
14. You agree that the train arrived in good shape, with no major damage or flaws, and free of graffiti.
15. You agree that the function of the train and rules were demonstrated to you with proper care from (Jumpingwithus, LLC)
16. Jumpingwithus staff will load the train or unload from the trailer.
17. Only trained drivers of Jumpingwithus, LLC will be allowed to transport children on the train.
18. Never use indoors.
19. We will never go through rivers, ponds, or streams by train.
The Train was inspected by Jumpingwithus, LLC today before any children were allowed to ride.

The train is clean of all trash, debris, and foreign objects.
IT'S A GAME-TIME RENTAL AGREEMENT
SUPERVISED CHILDREN:
IT’S A GAME TIME LLC requires a parent or responsible adult to be always present inside or outside the trailer.
FOOD/DRINK:
IT’S A GAME TIME LLC does not allow food or drinks inside the video game theater. Please have your guests consume them outside of the game theater.
ALCOHOL/DRUGS:
You may serve alcohol at an IT’S A GAME TIME LLC event or party; however, we may require an on-site security surcharge and/or security deposit when alcohol is served. We may reserve the right to refuse, cancel or cut short any party or booking when alcohol is served. Drugs of any sort will not be tolerated in or around the IT’S A GAME TIME LLC equipment. Any observed use of illegal or legal narcotics will immediately terminate the party.
REFUSAL OF SERVICE:
IT’S A GAME TIME LLC reserves the right to refuse service to clients if we observe behavior that we deem a potential threat to our employees, guests, or equipment. Such behavior includes, but is not limited to, obvious intoxication, observed or suspected drug use, aggressive language or behavior, unsafe surroundings, etc. In this case, we may refuse to start a party or terminate an ongoing event.
DAMAGE/INJURY:
ITS or any of its employees will not be responsible for any damage to property resulting from a request by the client to position the theater in a specific location. This includes both above-ground and below-ground property/equipment damage. Additionally, IT’S A GAME TIME LLC reserves the right to charge the client’s credit card for damages to the trailer or equipment resulting from careless or willful damage by the guests. IT’S A GAME TIME LLC or its employees assume no responsibility for any injuries sustained on the client’s property or designated location. All liability for damages or injuries is the sole responsibility of the client and/or host.
PICTURES:
While your party is in effect, the Game Coach will be taking pictures of the party from inside the trailer. You will then be able to view these pictures on the IT’S A GAME TIME LLC Facebook Fan Page and copy them to your files. If you do not want our Game Coach taking these pictures or posting them on the Fan Page, you can choose the “no photo” option during booking. This is a service we provide to our guests so they can be sure to capture their party as it happens.
IT’S A GAME-TIME LLC TRUCK/TRAILER:
When the truck pulls up, we will try to park in the most level & flat area or logical spot to accommodate your party. Sometimes, we park in your neighborhood street, so you might want to let your neighbors know (in case they may object) or let us know if you have a preferred spot for us. We might also have to block a driveway. **Please keep in mind that our Game Coach will not park anywhere that may cause a danger to persons, property, or equipment. Our truck and trailer combination is very long, and we will need a minimum of 50 feet of space to park. Additionally, our Game Coach will never disconnect the truck from the trailer at a party/event without prior approval nor park off a hardened surface.
Booking any party with IT’S A GAME TIME LLC constitutes your agreement with these policies.
This is a legally binding Consent Form and Release of Liability made voluntarily by me, the undersigned Releasor, on my behalf, and on behalf of my heirs, executors, administrators, legal representatives, and assigns to the [FOAMTASTICJOY A JUMPINGWITHUS LLC COMPANY and its' CONTRACTORS] (hereinafter "The Organization")
The undersigned hereby acknowledges that any activity involving the provided equipment involves an inherent risk of physical injury and assumes all such risks. The undersigned hereby agrees that for the sole consideration of The Organization allowing the undersigned to participate in the above-named activity for which or in connection with which the Organization has made available any equipment, facilities, grounds, or personnel for such programs or activities, the undersigned does hereby release and forever discharge The Organization, its members individually, and its officers, agents, and employees of any claims, demands, rights and causes of action of whatever kind of nature, arising from and because of any known and unknown, foreseen and unforeseen bodily and personal injuries, damage to property, and the consequence thereof, resulting from participation in or in any way connected with the above-named activity.
In an emergency, I am solely responsible for all medical and other costs arising from bodily injury or any loss sustained through participation in this activity.
By executing this agreement, I accept and assume full responsibility for all injuries, damages, and losses of any type that may occur to me and any participants I supervise. I hereby fully and forever release and discharge The Organization, its officers, employees, and insurers, including any selfâÂÂÂÂinsurance funds of the Organization, from all claims, demands, damages, rights of action, present and future, whether the same be known or unknown, anticipated, or unanticipated.
PLEASE DON'T TURN THE OFF POWER TO OUR INFLATABLES AND BLOWERS AT ANY TIME DURING YOUR RENTING. BY TURNING OFF THE POWER, IT COULD CAUSE DAMAGE TO THE INFLATABLES AND REPLACEMENT COSTS COULD BE UP TO $7,500.00 OR MORE
BY SIGNING MY NAME ON THIS CONTRACT, I, BEING THE LESSEE, CONTACT PERSON, LESSEE REPRESENTATIVE, OR OTHER INDIVIDUAL ASSUMING THE ROLE OF LESSEE, ACKNOWLEDGE THAT I HAVE COMPLETELY READ AND UNDERSTAND THIS CONTRACT AND ANY AND ALL ACCOMPANIED ADDENDUM(S). I HAVE BEEN FULLY INSTRUCTED BY JUMPINGWITHUS, LLC & ITS A GAME TIME, LLC PERSONNEL AS A TRAINED OPERATOR FOR THE AFOREMENTIONED EQUIPMENT AND HAVE HAD ALL OF MY QUESTIONS ANSWERED TO MY SATISFACTION. I UNDERSTAND I AM SOLELY RESPONSIBLE FOR ADHERING TO THE TERMS SET FORTH BY THIS RENTAL CONTRACT AGREEMENT AND ANY AND ALL ACCOMPANIED ADDENDUM(S).
